Acceptable Use Policy
INTRODUCTION
We believe our customers should be all be given a fair go. We also believe that there should be certain rules on how services are used to ensure:
- we protect the safety and rights of other users and IT’S FUBAR Pty Ltd;
- we safeguard the quality of service for our customers and other users of our wholesale providers;
- that our services are not used to facilitate illegal or unlawful activity.
We may immediately suspend, cancel or restrict the supply of service to you if you (or any person who accesses the service) use the service in any way which breaches this Acceptable Use Policy.
PROHIBITED USE
You (or any person who accesses the service) must not use our services for anything illegal or unlawful. This includes, but is not limited to using the service:
- for any purpose if we advised you that such purpose was prohibited in your Application or the relevant service Description;
- in any way which damages or interferes (or threatens to damage or interfere) with the operation of a service;
- to expose IT’S FUBAR Pty Ltd or it’s suppliers to any liability;
- in any way which makes it unsafe or which may damage any property or injure or kill any person;
- to distribute malicious software (such as password guessing programs, keyboard loggers, viruses or trojans);
- to make inappropriate contact with children or minors;
- to access, store, reproduce, distribute, publish or commercially exploit any information or material of any kind that infringes any copyright, patent, trademark, design or other intellectual property right;
- for hacking or gaining improper access to someone else’s information;
- to send, or assist in the sending of Spam, or otherwise breach the Spam Act 2003 (Cth);
- to make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam;
- to access, store, reproduce, distribute or publish any content which is prohibited or unlawful under any Commonwealth, State or Territory law or classification system.
UNREASONABLE/EXCESSIVE USE
You must use your service fairly in accordance with any download, capacity or usage limits stated in the specific plan. We may limit, suspend or terminate your service if you unreasonably exceed such limits or excessively use the capacity or resources of our network in a manner which may hinder or prevent us from providing services to other customers or which may pose a threat to the integrity of our network or systems.
This includes the use of our network for purposes such as (but not limited to):
- running peer to peer download servers (such as seedboxes);
- running a telemarketing or call-centre without our consent;
- running tor exit nodes.
SECURITY
You are responsible for maintaining the security of your service, including protection of account details, passwords and protection against unauthorized usage of your service by a third party. We recommend that you take appropriate security measures such as installation of a firewall and use up to date anti-virus software. You are responsible for all charges incurred by other persons who you allow to use your service, including anyone to whom you have disclosed your password and account details.
PENALTIES
If we think you have breached this policy, we may act at our discretion. Actions we undertake may include:
- requesting that you change the way you use our services;
- issuing a formal warning;
- restricting your access, with or without notice;
- suspending or ending your service, with or without notice.
If we think you have broken the law, we will report you to the police or relevant governing body and give them your personal information (per our Privacy Policy available online at itsfubar.com.au/legal/privacy-policy/).
