Privacy Policy
INTRODUCTION
IT’S FUBAR Technology Services (IT’S FUBAR P/L ATF Caldicott Business Trust) recognises the importance of privacy protection and supports the National Privacy Principles set out in Schedule 3 of the Privacy Act 1988 (Cth). We are committed to protecting your personal information, and this document explains how we collect, use, share, disclose and store your personal information.
This policy applies to all personal information collected through our interactions with you.
WHO’S INFORMATION WE COLLECT
We collect personal information about individuals and organisations who are:
- Prospective customers: This includes people we think may be interested in our products and services as well as people who have expressed interest in obtaining or learning more about those products and services.
- Current Customers: This includes people who purchase our products or services or who hold an account with us; and
- Past Customers: These are people who have purchased our products or services but do not currently have an active account with us.
We refer to these collectively as customers.
HOW WE COLLECT INFORMATION
We normally collect personal information about our customers directly. For example, we collect personal information when provided information by phone, email, or social media, or when a customer enters personal details on our websites, or into any of our platforms or systems.
In some cases, we may also collect information about them indirectly, including from:
- third parties such as our related companies, credit reporting bodies and credit providers;
- a customer’s authorised representatives;
- other telecommunication and information service providers;
- our equipment; and
- publicly available sources of information.
WHAT INFORMATION WE COLLECT
The information we collect will depend upon the nature of our customers’ interactions with us. Typically, personal information we collect may includes (but is not limited to):
- name, date of birth, email address, telephone number(s) and residential address.
- payment details (such as credit card or debit card details) provided when purchasing our products and services;
- Financial and credit information, including credit history, employment history, remuneration details, bank account and credit card information, information about assets and income and details of relevant court judgments and bankruptcies. We need this information to assess creditworthiness and financial suitability of Current Customers and Prospective Customers.
- Employment information, including information about employment history including current and past employers. We may need this information to assess the financial position of a person who applies to become our customer, per TCP regulations.
- proof of identity information, including passport number, driver licence number, Medicare number or other government identifiers. We need this information to ensure you are who you say you are, and to keep our customer records accurate and up-to-date. We also may be required to obtain proof of identity information by law. For example, the Telecommunications Act 1997 and the Service Provider (Customer Identity Authentication) Determination requires us to obtain specified proof of identity information before providing mobile telephone services.
- Information about certain medical conditions and concession entitlements. This may entitle the person to concessional tariffs or other benefits that may be available with our products or services, or other payment assistance programmes.
- Information relating to change of name or status, which may include marriage certificates, death certificates and other official documentation. We may need this information where we are asked to close or transfer an account.
We also collect information about the way our customers use our products and services. This includes information about:
- service usage (including use of communications services, internet usages);
- payment patterns and history; and
- inquiries and complaints.
WHY WE COLLECT IT
Your personal information is collected and used by us so we can go about the day to day delivery of our services and products. For example, we may use your personal information to:
- verify your identity;
- assess whether you are eligible for our services;
- assist you to complete an application that was abandoned;
- carry out checks for credit-worthiness and for fraud;
- process your application to become a customer;
- provide the services you require;
- deal with enquiries and provide customer support;
- manage your services, including billing, account management and collecting debts;
- research and develop our products and services;
- provide information to the manager of the Integrated Public Number Database (IPND).
HOW WE SHARE IT
We may disclose personal information about our customers to a range of third parties, most of which act as service providers to IT’S FUBAR. Our service providers are required by contract to protect the confidentiality of the personal information we share with them and to use it only to provide specific services on our behalf.
For example, we may disclose your information to:
- the Telecommunications Industry Ombudsman (for complaint management purposes);
- organisations that process banking transactions;
- organisations that process debt collection;
- printers, mail distributors, couriers and dispatch centres;
- IT service providers and data managers;
- legal, accounting, insurance and business advisory consultants services.
Additionally, we may disclose personal information:
- to government agencies (such as Centrelink) for the purpose of establishing or verifying eligibility for concessions and similar entitlements;
- to law enforcement agencies for law enforcement or security purposes;
- to a credit reporting agency or credit collection agency for credit checking, collection or credit reporting purposes, in accordance with the requirements of the Privacy Act 1988;
- to third party service providers of ours, for the purposes of identity verification, fraud detection, and/or debt collection.
We may also disclose personal information if required by law.
HOW WE STORE AND PROTECT IT
While some of the personal information we collect is held in hardcopy form, most personal information is stored in electronic databases.
We keep digital customer information stored on dedicated, hardened systems.. We take particular care with credit card details, which are not stored in our systems – and are instead encrypted and tokenised by our payment gateway providers.
All systems we run and maintain are regularly cyber security audited, and we have extensive processes in place to ensure that our information systems and files are kept secure from unauthorised access and interference.
OVERSEAS DISCLOSURE OF INFORMATION
We may disclose some personal information to individuals and organisations that are outside Australia as necessary.
IT’S FUBAR has relationships with outsourced service providers who assist us to develop and maintain our systems and services. This may involve personal information being transferred to providers based in Denmark, France, India, New Zealand, Singapore, Ukraine and the United Arab Emirates.
ACCESSING AND CORRECTING PERSONAL INFORMATION
We periodically maintain and update the personal information we hold as it becomes necessary. A customer can typically make changes to their personal information directly through our customer portals, or by contacting us at support@itsfubar.com.au or by calling (03) 5292 3655.
COMPLAINTS AND FURTHER INFORMATION
Any privacy complaints will be handled in accordance with our complaint handling process available online at itsfubar.com.au/legal/complaints-handling/.
