Customer Service Guarantee Waiver


INTRODUCTION

IT'S FUBAR is committed to providing our customers with excellent services at low costs, but we can only do this if customers waive various rights that are specified in the Telecommunications (Consumer Protection and Service Standards) Act 1999 (“the Telecommunications Act”) and the Telecommunications (Customer Service Guarantee) Standard 2011 (“the CSG”).

This waiver does not stop you from contacting us regarding a fault with your service no does it allow us to avoid doing our best to fix a fault with your service. You should also be fully aware that IT’S FUBAR is subject to constraints and limitations of our wholesale partners.

CUSTOMER SERVICE GUARANTEE WAIVER

Part 5 of the Telecommunications Act allows Us to propose that you waive the protections and rights provided for under the CSG.

By having our customers consent to CSG waivers, we can offer lower set up fees, usage charges and monthly charges. We are only able to provide this service on the condition that it is not required to meet the CSG performance standards. So that you may utilise this service, you must waive your rights under and in respect to the CSG.

Please read the below paragraphs carefully as they contain important information affecting your rights:

  1. IT’S FUBAR’s full name is IT’S FUBAR Pty Ltd as trustee for Caldicott Business Trust, trading as IT’S FUBAR Technology Services (us, our, we).
  2. By consenting to this waiver, you agree to waive your Customer Service Guarantee (“CSG”) protection rights under Part 5 of the Telecommunications (Consumer Protection and Service Standards) Act 1999 in full.
  3. In particular, the provisions you are waiving are:
    1. Provision of written information about the CSG.
    2. Guaranteed maximum connection periods.
    3. Guaranteed maximum rectification periods.
    4. Guaranteed timeframes or windows for making appointments and changing appointments.
    5. Compensation for failure to meet these performance standards.
  4. This waiver will take effect on the date that you place this service order. You are under no obligation to consent to this waiver but if you do not consent to this waiver, we reserve the right not to provide the service to you.
  5. By applying for our service, you acknowledge that you waive the CSG and accept our Customer Terms.
  6. This waiver will apply to your service if it is relocated, or any other telephony services are provided by Us to You.
